Manual)<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>This means the U.S. petitioner must be a qualifying<\/strong><strong> employer related<\/strong><strong> to the foreign company where the applicant worked.<\/strong><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Qualifying Relationship Between Companies<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The U.S. entity must have a qualifying corporate relationship with the foreign employer:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Parent<\/li>\n\n\n\n<li>Subsidiary<\/li>\n\n\n\n<li>Affiliate<\/li>\n\n\n\n<li>Branch<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">USCIS stresses:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThe U.S. employer must have been doing business for at least 1 year.\u201d (USCIS Policy Manual, Ch. 4, Sec. B)<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Employment Abroad Requirement<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The beneficiary must have been employed:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>For at least 1 continuous year<\/strong> in the 3 years prior to filing (or prior to entry as a nonimmigrant, such as L-1A).<\/li>\n\n\n\n<li>In a <strong>managerial or executive capacity<\/strong>.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Note: If the person already entered the U.S. in L-1A status, the \u201c1 year abroad\u201d can be counted before the transfer.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>&nbsp;Managerial or Executive Capacity<\/strong><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The heart of EB-1C is whether the role is truly <strong>managerial or executive<\/strong>, not just supervisory.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Executive capacity means:<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cAn assignment in which the employee primarily:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Directs the management of the organization or a major component or function of the organization;<\/li>\n\n\n\n<li>Establishes the goals and policies of the organization, component, or function;<\/li>\n\n\n\n<li>Exercises wide latitude in discretionary decision-making; and<\/li>\n\n\n\n<li>Receives only general supervision or direction from higher-level executives, the board of directors, or stockholders of the organization.\u201d<br>(INA 101(a)(44)(B); USCIS Policy Manual, Ch. 4, Sec. C.2)<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>Managerial capacity means:<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cAn assignment in which the employee primarily:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Manages the organization, or a department, subdivision, function, or component of the organization;<\/li>\n\n\n\n<li>Supervises and controls the work of other supervisory, professional, or managerial employees, or manages an essential function;<\/li>\n\n\n\n<li>Has the authority to hire and fire or recommend personnel actions (if other employees are directly supervised); and<\/li>\n\n\n\n<li>Exercises discretion over the day-to-day operations of the activity or function.\u201d<br>(INA 101(a)(44)(A); USCIS Policy Manual, Ch. 4, Sec. C.1)<br><\/li>\n<\/ul>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>5. Key Considerations by USCIS<\/strong><\/h2>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Job Duties &gt; Job Title<\/strong>: USCIS looks at <strong>actual job duties<\/strong>, not just titles.<\/li>\n\n\n\n<li><strong>Supervisory roles<\/strong> over low-level staff do <strong>not<\/strong> qualify; the role must be strategic, not operational.<\/li>\n\n\n\n<li><strong>Functional Managers<\/strong>: Even without direct reports, a person managing an <strong>essential function<\/strong> (e.g., global product development, legal compliance) may qualify.<\/li>\n\n\n\n<li><strong>Startups<\/strong>: Must show strong financials, staffing, and business operations to prove a \u201creal\u201d managerial\/executive role.<br><\/li>\n<\/ul>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>6.
